RCAHosting (referred to hereinafter as “RCAHosting,” “rcahosting.com,” “our,” “we,” and “us”) is a web hosting business. All accounts on our web servers are subject to the terms and conditions described in this document (the “Agreement”). By placing information on our servers, you acknowledge that you have read, understand, and agree to be bound by the terms and conditions below.

1. User Conduct

Our services may only be used for lawful purposes. You and any user of the services through you (“End User”) must not:

• Post or transmit unlawful, threatening, abusive, defamatory, obscene, or otherwise objectionable information.
• Engage in activities that violate any laws applicable to RCAHosting or your local jurisdiction.

2. Non-permissible Content and Conduct

• No file storage repository: Hosting accounts cannot be used for storing MP3s, videos, or other similar files.
• No adult sites: Adult content or links to such sites are prohibited.
• No warez: Sites with warez, cracks, serials, etc., are not allowed.
• No game sites: Hosting accounts cannot be used for game sites.
• Intellectual Property violations: Content that infringes on intellectual property rights is prohibited.
• Distribution of multimedia formats: Only permitted if you are the author or have explicit permission from the copyright holder.

Accounts containing prohibited content will be disabled or deleted at our discretion without prior notice and are not eligible for a refund.

3. Banned Scripts

Users may not install the following scripts on our servers:

• Third-party chat scripts (only allowed in your Control Panel).
• Ultimate Bulletin Board (all versions), Yet Another Bulletin Board, Ikonboard (CGI version), Movable Type (All types), Greymatter, Ultimate Toplist, AlienForm, FormMail.
• Shell, SSH, Telnet Scripts and alternatives, Proxy Servers, any script using a large number of flat files or flat file databases.

Accounts containing banned scripts will be suspended without advance notice.

4. Zero Tolerance Spam Policy

We have a zero tolerance stance against spam. Any user sending spam or bulk email will have their account terminated without notice. RCAHosting reserves the right to make necessary changes or disable any non-compliant web site, account, or database at its discretion. A processing fee of $20 per spam message will apply.

5. Data Backup

RCAHosting may regularly back up server data for disaster recovery purposes. However, we do not guarantee the availability of these backups. Customers are advised to make regular backups using tools provided in our Control Panel.

6. Indemnification

You agree to indemnify and hold harmless RCAHosting from any liability, penalties, losses, damages, costs, expenses, attorneys’ fees, and claims caused by or resulting from your use of the service.

7. Refusal or Discontinuation of Service

RCAHosting reserves the right to refuse or discontinue service at its discretion. We may deny access without notice if you engage in conduct we believe violates this Agreement. We have no responsibility to notify third-party providers of service discontinuation.

8. No Warranties

RCAHOSTING MAKES NO WARRANTIES FOR THE SERVICES PROVIDED. SERVICES ARE OFFERED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

9. Customer Risks

By using our services, you assume all responsibility and risk. RCAHosting is not responsible for the files and data on your account. Users must maintain backup files of their data.

10. Account-Holder Identification Information

You must be at least 18 years old or have parental consent to use our services. You agree to provide truthful contact information and keep it updated. You must be an authorized user of any credit card you use on our site.

11. Sharing of Account Space & Resale Restrictions

The account purchased is for your use only. You are solely responsible for all account activity.

12. Purchasing Third Party Services Through RCAHosting

Third-party services may be offered through our site. Any purchase and use of these services are solely between you and the third-party provider. We do not warrant or support these services.

13. Payment & Other Information

You agree to pay for the services in advance. Services will be billed on a recurring basis until you notify us of cancellation. If payment cannot be processed, your account will be suspended or terminated.

14. Copyright Infringement & DMCA Process

We comply with the DMCA and will act upon valid copyright infringement notices. Notices must be sent to our designated agent and include all required information.

15. Miscellaneous

We reserve the right to amend these terms at any time. Continued use of our services constitutes acceptance of the new terms. This Agreement is governed by the laws of Florida. Disputes will be resolved in the courts of Florida.

16. Agreement Acknowledgement

This Agreement constitutes the entire agreement between you and RCAHosting. By using our services, you acknowledge that you have read and agree to these terms.

17. Money Back Guarantee

Each hosting plan includes a 30-day money-back guarantee, excluding overages and third-party services. Only first-time accounts are eligible for a refund. Abuse of the refund guarantee is prohibited.
